CLLC Members and Investors:
The 2024 legislative session how now concluded, and this was another highly challenging legislative session for our rental housing profession.
The recent proliferation of pro-tenant legislation became another major policy initiative of the legislature. The bills were introduced as a continued response to address Colorado’s “affordable housing crisis” and the Governor’s housing agenda comprised of a package of legislation from a prohibition on occupancy limits to Accessory Dwelling Units (ADUs) and increasing housing density around transit stations – Transit Oriented Communities or (TOCs).
The CLLC is equally concerned with the increased cost of both rental and purchased housing in Colorado and has consistently supported legislation bringing tax incentives, construction defects reform law, and rental assistance to Colorado’s lower-income families, workforce, and the broader tenant community.
Unfortunately, a growing number of these bills are unbalanced and fail to recognize the market forces pushing rents, with functioning eviction laws as an essential last resort for property owners to regain their owned properties. Due to the counterproductive structures of these bills, the CLLC continues to be an important legislative voice for our members.
During 2024, we were again at the table and highly active in the Capitol advocacy process testifying, holding a day at the Capitol, and spending grueling volunteer hours of legislative negotiations with bill sponsors, stakeholders, and lobbying legislators for votes in the various Committees and on the House and Senate floors.

HB 24-1057, Prohibit Algorithmic Devices Used for Rent Setting
The CLLC made a real difference in amending, and then killing HB 24-1057, around rent algorithms. The CLLC found the original draft confusing, and poorly drafted and engaged with the bill sponsor to further clarify the bill with amendments – suggesting a best practice for how to utilize market data to guide setting rents. As the bill moved to the Senate, we worked with other housing organizations to add much improved language through a Senate amendment, which was vigorously fought by the bill sponsors and adopted by the closest margin on the Senate floor. The House sponsors then sought to strip the amendment from the bill by rejecting the work of the Senate – which held firm in its position with the CLLC supported amendment effectively killing the bill for this session. We are already hearing a version of the bill will be re-introduced in the 2025 session, so this issue is certain to return for more work beginning in January.

Prohibit Algorithmic Devices Used for Rent Setting |
HB 24-1098 For Cause Eviction
It is with great disappointment we report the passage of HB 24-1098, “Cause Required for Eviction of Residential Tenant.” This legislation essentially eliminates the ability of landlords to non-renew their tenants. While there are certain exceptions, such as the allowance for a probationary occupancy period where a non-renewal continues to apply in the early term of a lease, this legislation is one of the most draconian pieces of legislation to pass the General Assembly. Even with compromise amendments negotiated and added by other housing organizations, the CLLC continued in opposition to this legislation – keeping it from a final vote while the sponsors had to redouble their efforts to pass the legislation and overcome our lobbying efforts.
While we were instrumental in killing this legislation during the previous legislative session, the revived effort received support from the Governor, the House Speaker, and the House Majority Leader (who was a Co-Prime bill sponsor in the House). These created powerful political dynamics that we were not able to be overcome – even though our efforts supporting an amendment from Senator Kyle Mullica (D-Adams County) came within one or two votes of either substantially amending the bill to requiring additional notice for non-renewals, or fully stopping the bill in the Senate.
Upon passage of HB 24-1098, the CLLC also pressed for a veto in a letter to the Governor. The governor’s office did respond with a meeting to better understand our concerns but moved forward with the signing believing the legislation had been improved to adequately address our points – including amendments the Governor required for his acceptance.
We continue to believe this legislation will have severe consequences for rental affordability as the legislation added to owner risk, while moving more disputes into the eviction process.

Warranty of Habitability SB 24-094
The update to the Warranty of Habitability was another enormous legislative effort, working to analyze the legislation and be able to offer substantive changes (the legislation was forty-two pages when introduced), and was amended nine times with both Senate and House amendments. The CLLC worked vigorously with other housing organizations to add additional amendments, but the objections of the sponsors and the tenant organizations prevailed. Beyond its length, this new law is very complex addressing a long list of issues including: timelines for remediation, penalties for landlords who fail to meet the warranty and repair standards, expanding the list of warranty items and what constitutes “habitability,” requirements for temporary housing, documentation and recordkeeping, legal standards/court procedures around claims, and anti-retaliation against tenants bringing such claims.

Safe Housing for Residential Tenants |
HB 24-1259 Price Gouging in Rent Declared Disaster
This legislation resulted from the Boulder area fires which destroyed a significant number of surrounding homes and neighborhoods and moved families into temporary rental housing pending the rebuilding of their homes. While the legislation was well intended, the CLLC had concerns about the overly broad gubernatorial authority included in the bill, and the controlling of rents during those disaster declarations. Like the bills we actively work, the real action on this legislation was again in the Colorado Senate, where the CLLC supported amendments to the bill with the Governor’s office and other housing providers, such as the Colorado Apartment Association. While not every change we sought was incorporated into the legislation, the Senate amendments represent real improvements to the legislation.

Price Gouging in Rent Declared Disaster |
SB 24-064 – Monthly Residential Eviction Data & Report
On the proactive side, the CLLS supported SB 24-064 bringing a source of objective data on residential evictions into the policy discussions. While industry data is often questioned as biased, this bill brings an opportunity to have available data the CLLC, other housing, and tenant organizations can jointly cite in their policy discussions. We look forward to supporting other similar legislative initiatives bringing better data collection and transparency into the rental housing discussion.

As we move past the legislative session and into another election season, the CLLC is actively meeting with legislators and legislative candidates in preparation for the 2025 Colorado legislative session.
